Recent Meetings & Announcements

Meetings and announcements that affect the solid waste industry are summarized in this Bulletin. Please feel free to contact us for more detailed information on any of these issues.

Commission on the Future of Virginia’s Environment – will meet on October 15, 2002 at 10:00 a.m. at the General Assembly Building, 9th and Broad Street, Richmond, Virginia in Senate Room A. This is a general meeting of the Commission.
The Department of Environmental Quality (DEQ) has announced that the Virginia Solid Waste Management Regulations – 9 VAC 20-80 Amendment #3 is now available for review and public comment. The draft will be published in the Virginia Register on October 7, 2002; however, it is now available on DEQ’s web page as well as on the Town Hall web page (links are available at www.JoyceEngineering.com). Tentatively, the public comment period will last through December 6, 2002. According to DEQ, Amendment 3 is intended to incorporate and address statutory changes enacted by the General Assembly since Amendment 2 of the Virginia Solid Waste Management Regulations. These remaining statues to be addressed in the regulations include but are not limited to the following:

• The disposal capacity guarantee as required by Code of Virginia §10.1-1408.1.B.6.
• Host community agreements as required by §10.1-1408.1.B.7.
• Reporting requirements for locally owned facilities as required by §10.1-1408.1.B.8.
• Director’s determinations as required by §10.1-1408.1.D.1 and 2.
• Permit condition for capacity guarantee as required by §10.1-1408.1.P.

When reviewing these amended regulations, special attention should be given to 9 VAC 20-80-300 Groundwater Monitoring Program, as this is a new section that combines all groundwater requirements, regardless of the type of landfill. Also, note changes in 9 VAC 20-80-500 Permit Application Process. This section addresses the information required in the "notice of intent" to demonstrate need when applying for a new solid waste management facility or an amendment allowing a facility expansion or an increase in capacity.

In addition, the regulation will be updated to correct any errors or omissions resulting from previous amendments and any outdated material.

Public Hearings, Public Comment Periods & Open Meetings

An open meeting of the Virginia Board for Waste Management Facility Operators will held on October 3, 2002 at 10:00 a.m at DPOR – 3600 West Broad Street, Richmond, Virginia. Routine business will be conducted and a public comment period will be held at the beginning of the meeting.

Public Hearing
will be held on October 10, 2002 at 9:00 a.m. at DEQ – 629 E. Main Street, Richmond, Va. to discuss 9 VAC 5-40 Existing Stationary Sources (Rev J00) and 9 VAC 5-40 Existing Sources (Rev K00). The purpose of the proposed action is to establish emission standards that will require owners of commercial/industrial solid waste incinerators to limit emissions of organics, metals, and acid gases to a specified level necessary to protect public health and welfare (J00). In addition, the proposed action is to control emissions from small municipal waste combustors (K00). Public Comments may be submitted until 4:30 p.m. on November 8, 2002.

An open meeting of the Virginia Recycling Markets Development Council will be held on October 21, 2002 at 10:00 a.m at the Clarion Hotel and Conference Center, 500 Merrimac Trail, Williamsburg, Virginia. This meeting of the council is in conjunction with the first day of the annual Virginia Recycling Association Conference and Tradeshow.

Public Hearing will be held October 24, 2002 at 2:00 p.m. at DEQ – 629 E. Main Street, Richmond, Virginia of the Virginia Waste Management Board to discuss 9 VAC 20-110 Regulations Governing the Transportation of Hazardous Materials. The purpose of the proposed action is to revise definitions as necessary for consistency with federal regulations, update references to cite current federal regulations, remove obsolete sections, and revise, as necessary, requirements for registration of shippers. Public Comments will be received until November 8, 2002.

Public Hearing will be held October 1, 2002 at 2:00 p.m. at DEQ West Central Regional Office, 3019 Peters Creek Road, Roanoke, Virginia; October 2, 2002 at 2:00 p.m. at DEQ Piedmont Regional Office, 4949-A Cox Road, Glen Allen, Virginia; and October 3, 2002 at 2:00 p.m. at DEQ Tidewater Regional Office, 5636 Southern Boulevard, Virginia Beach, Virginia to discuss 9 VAC 25-260 Water Quality Standards and adopt new regulations entitled: 9 VAC 25-280 Groundwater Quality Standards. The purpose of the proposed action is to include updates and revisions to water quality criteria, use designations, mixing zones and the antidegradation policy. The amendments also move the groundwater standards into a separate regulation (9 VAC 25-280). This regulation contains the existing groundwater standards, criteria and antidegradation policy as well as pertinent definitions, general requirements, requirements for modification, amendment, and cancellation of standards and designations of authority. Public Comments will be received until November 1, 2002.
